Terms and Conditions
Cannis's terms of use: what the platform does, what it doesn't do, what's up to you and what's up to us. They're written to be understood.
This English version is provided for reference only. In case of any discrepancy, the Spanish version prevails.
What this document says
A summary to help you find your way. It doesn't replace the full text: if anything differs, the articles below prevail.
01 Who we are
Cannis is an Argentine digital platform that organizes legal access to medical cannabis by connecting patients, health professionals, legal advisors, agronomists and civil society organizations on a single management system.
Cannis es una marca registrada ante el Instituto Nacional de la Propiedad Industrial (INPI) y una Obra Inédita de Software inscripta en la Dirección Nacional del Derecho de Autor (DNDA).
02 Purpose and scope
These Terms govern access to and use of the site cannis.org, its subdomains and every product the platform offers: Repronline, Cannis Health, the Portal, each organization's Sede Digital, Comunidad Cannis, Cannis Searcher, Cannis AI and the public API.
They constitute an adhesion contract between you —hereinafter, the User— and Cannis. By creating an account, contracting a service or simply browsing the site, you accept these terms in full.
The Privacy Policy and the specific informed consents signed for each service are incorporated into these Terms and form an inseparable part of them.
03 What Cannis is NOT
This is the most important section of the document, which is why it comes first.
- Cannis does not grow, produce, market, transport or dispense cannabis or any of its derivatives, in any form.
- Cannis does not provide health services. It does not diagnose, recommend treatments or prescribe. Professionals who use the platform do so under their own license and their sole professional responsibility.
- Cannis does not grant REPROCANN. The registry is administered and decided by the National Ministry of Health. The platform supports the process; it cannot guarantee an outcome or a timeframe.
- Cannis does not provide individualized legal advice. The informational content of the site —tutorials, guides, Cannis AI answers— is general information and does not constitute a legal opinion.
- Cannis is not a party to the relationship between the patient and their organization or between the patient and their professional. It provides the tool with which those relationships are managed and recorded.
The medicinal use of cannabis in Argentina requires registration with REPROCANN or falling within one of the avenues the regulations allow. Using the platform does not by itself authorize any conduct.
04 Legal framework
Cannis operates within the Argentine legal system and, in particular, within the following framework:
- Law 27,350 — medical and scientific research into the medicinal use of the cannabis plant and its derivatives, and its Regulatory Decree 883/2020, which creates the Cannabis Program (REPROCANN).
- Law 27,669 — Regulatory Framework for the Development of the Medical Cannabis and Industrial Hemp Industry, and the enforcement authority it creates.
- Law 25,326 on Personal Data Protection and its Decree 1558/2001, with the Agency for Access to Public Information as supervisory body.
- Law 26,529 —amended by Law 26,742— on the Rights of Patients in their relationship with health professionals and institutions: informed consent, medical records and confidentiality.
- Law 25,506 on Digital Signature, for prescriptions and electronically signed documents.
- Law 24,240 on Consumer Protection and articles 1092 to 1122 of the Civil and Commercial Code on consumer contracts.
- Law 11,723 on Intellectual Property.
05 Acceptance and capacity
To create an account you must be at least 18 years old and have full capacity to contract.
An underage patient may access the services through their legal representative, who acts on their behalf, gives consent and is responsible for the accuracy of the data. The principle of progressive autonomy of the Civil and Commercial Code and the patient rights recognized by Law 26,529 are respected.
Using the platform implies full acceptance of these Terms. If you don't agree with any of its clauses, don't use the service.
06 Accounts and credentials
The data you enter must be true, complete and up to date. Entering false data —your own or someone else's— is grounds for immediate suspension, in addition to any applicable liability.
The account is personal and non-transferable. You are responsible for keeping your password safe and for all activity carried out from your session. If you detect unauthorized use, let us know immediately.
Health professionals must prove a valid license and the qualifying documentation that corresponds to their specialty. Cannis verifies that documentation at sign-up, but the validity of the license is the sole responsibility of the professional.
Organizations must prove their legal incorporation and their authorization to operate. Whoever creates the account declares that they have sufficient authority to bind the organization they represent.
07 Roles and obligations
Report their health situation truthfully, keep their authorization current, use the product they receive exclusively for their personal treatment and not give, resell or transfer it to third parties in any way.
Practice within their scope and their license, obtain informed consent from their patients, protect professional secrecy and record clinical information with the diligence required by Law 26,529. The clinical decision is theirs and cannot be delegated.
Check each member's authorization before dispensing, respect the limits set by the regulations, keep traceability of their stock and deliveries, and process their members' data in accordance with Law 25,326. The organization is the controller of its members' data; Cannis acts as processor.
08 The services
Handling of the REPROCANN application: appointment with an authorized professional, video consultation, data entry and filing with the health authority. Cannis undertakes to handle it diligently; it cannot commit to the approval of the application or to the timeframe in which the State decides.
Once the regulatory period has expired without an answer, and if the User requests it, the platform supports the administrative claim —a request for expedited processing via Trámites a Distancia— and, if the delay persists, an amparo action for delay. The outcome of those actions cannot be guaranteed either.
Digital practice for health professionals. It includes scheduling, patient records, issuing electronic prescriptions, treatment follow-ups and settlement of fees. The professional is solely responsible for the clinical content they record and the prescriptions they issue.
Management tools for organizations: members, sites, stock, dispensing, cards and accountability reports. Each organization sets its own rules within what the regulations allow and is responsible for them.
Strain search engine for informational and educational purposes. The information comes from public and third-party sources; it is not a consumption recommendation or a guarantee about composition or effects.
Event registration and ticketing. The conditions of each event —capacity, refunds, rescheduling— are set by its organizer and stated in its listing.
Authorized organizations are granted a personal, non-transferable access token. Cannis may limit use, revoke the token or suspend access in the event of abusive or automated use, or use outside its purpose.
09 Payments and right of withdrawal
Amounts are stated in Argentine pesos and include applicable taxes unless otherwise indicated. Payments are processed through external providers; Cannis does not store full card data.
Under article 34 of Law 24,240, for any remote contract you have ten (10) calendar days from the contract or from the availability of the service —whichever is later— to revoke your acceptance without giving a reason and at no cost.
To exercise it, let us know through any of the contact channels in section 18. If the service has already been fully provided with your express agreement, the right may not apply, on the terms the law itself sets out.
You can cancel any contracted service through the same means you used to contract it, with no requirements beyond those asked at sign-up.
10 Cannis AI
Cannis AI is a support tool built on third-party language models. It is governed by these rules, which are part of the contract:
- It does not issue diagnoses or prescriptions. Its answers are guidance and general information.
- It can be wrong. Like any system of its kind, it can produce incomplete or incorrect information. Always check with a professional.
- Within the practice it suggests, it doesn't execute. Every action on clinical data is confirmed by the professional. Professional responsibility is not delegated to the system.
- Don't enter third parties' personal data or identifiable clinical information in the public chat.
11 Content and intellectual property
The platform's software, design, trademarks, logos, texts and databases are owned by Cannis or used under license, and are protected by Law 11,723 and trademark legislation. No license is granted over them beyond personal use of the service.
The content you upload remains yours. You grant us a limited, non-exclusive and revocable license, solely to provide you with the service: storing it, processing it and showing it to whoever corresponds within the platform. We don't use it for any other purpose.
If you believe content published on the platform infringes your rights, write to us and we'll review it.
12 Prohibited conduct
The following is expressly prohibited:
- Using the platform to trade cannabis or any substance outside the legal framework.
- Giving, reselling or transferring to third parties the product received from an organization.
- Falsifying personal, clinical, license or authorization data.
- Impersonating another person, professional or organization.
- Accessing other users' data or attempting to break access controls.
- Extracting data in an automated way, reverse engineering or overloading the services.
- Publishing unlawful or discriminatory content, or content that encourages unsafe use.
13 Service availability
We work to keep the platform available continuously, but uninterrupted availability is not guaranteed. There may be interruptions due to maintenance, updates, failures of infrastructure providers or force majeure. When an outage is scheduled and significant, notice is given reasonably in advance.
Cannis may modify, suspend or discontinue features. If discontinuation affects a contracted service, notice is given in advance and the situation of those with an active service is resolved.
14 Liability
Cannis is responsible for the proper operation of the platform to the extent technically required and in accordance with applicable consumer legislation.
Cannis is not liable for:
- The clinical decisions of professionals or their consequences.
- The conduct of organizations towards their members.
- The decisions, delays or rejections of the health authority.
- The use each person makes of the product they receive.
- The accuracy of the data users themselves declare.
- Failures of third-party services beyond its control.
No clause of these Terms limits the rights that Law 24,240 grants consumers on a non-waivable basis.
15 Suspension and termination
You can close your account whenever you want. Cannis may suspend or close an account in the event of a breach of these Terms, a risk to the security of the platform or third parties, or a request from a competent authority.
Closing an account does not immediately delete the information the platform must keep by legal obligation —clinical records, dispensing receipts, accounting documents—. See the retention section of the Privacy Policy.
16 Changes to these Terms
We may update these Terms when the services or the applicable regulations change. The date of the last update is at the top of the document. When the change is substantial, notice is given through the account's contact channels reasonably in advance of it taking effect.
If you don't accept the new version, you can close your account. Continuing to use the platform after it takes effect implies accepting it.
17 Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic.
For any dispute arising from a consumer relationship, the competent court is the one corresponding to the consumer's domicile, under article 1109 of the Civil and Commercial Code. For all others, the ordinary courts of the Autonomous City of Buenos Aires.
Consumer protection. For any claim you can turn to the Prior Conciliation Service for Consumer Relations (COPREC) or to the enforcement authority in your jurisdiction, without prejudice to Cannis's contact channels.
