Law 27,350

Medical use of the cannabis plant and its derivatives in Argentina: what rights it recognizes, who it covers and how far it goes.

01 What is Law 27,350?

Law 27,350, passed on March 29, 2017, sets the legal framework for medical and scientific research into the medicinal, therapeutic and palliative use of the cannabis plant and its derivatives.

It recognizes the right to health of people who use cannabis for medical purposes and creates the institutional mechanisms for its regulation.

02 Purpose and scope

The main purpose of the law is to guarantee and promote comprehensive health care through:

  • Scientific research on medical cannabis.
  • Regulated access to treatments.
  • Public, controlled production.
  • Medical and health follow-up.

The law creates the National Medical Cannabis Program under the Ministry of Health.

03 Rights it recognizes

  • Access to the medical use of cannabis with a medical prescription.
  • Voluntary participation in the national program.
  • Protection of personal data and confidentiality.
  • Free access to derivatives in the cases set by the regulations.

The law puts a health and human-rights approach first, not a punitive one.

04 Registry and REPROCANN

Article 8 creates a voluntary national registry for patients, relatives and people authorized to use medical cannabis.

That registry is what we know today as REPROCANN, and it is where legal authorization is processed for:

  • Medical use.
  • Authorized personal cultivation.
  • Linking with an NGO or a solidarity grower.

05 Important limits and clarifications

  • The law does not legalize recreational use of cannabis.
  • Every authorization is subject to a medical prescription and to current regulations.
  • Failing to meet the conditions may lead to removal from the registry.
